High Court rules government’s anti-protest law enabling more police action is unlawful

Legal challenge to government’s lowered threshold to classify inconvenient protest to allow police to intervene succeeds

A legal challenge by rights group Liberty has won its court case against the government over its change to the definition of protests this morning.

The government had used ‘secondary legislation’ to push through a change to the definition of serious – avoiding proper parliamentary scrutiny – that meant anything more than ‘minor’ was ‘serious’, allowing police to lower the bar to escalating their actions to break up protests. The proposed changes had already been rejected in the Lords, so the government was using the move to bypass usual parliamentary process. Liberty said the government had no legal power to do this and the High Court has agreed that it acted unlawfully.

Liberty has demanded that police forces immediately cease the use of the new definition. The government has said it will appeal the ruling.

New York this week saw a ‘large’ pro-Israel demonstration, or at least it did if you take western news headlines at face value. But look beyond the headlines and even the ‘mainstream’ media can’t hide the truth – like CBS in the US, who had to admit that, in reality, only ‘a few dozen’ turned up:

The reality was in stark contrast to the presentation – and in stark contrast to the millions who turn out, every weekend, against Israel’s genocide and to support the people of Palestine against war crimes, oppression and apartheid.

Mandela’s grandson calls Lammy ‘apologist for genocide’

Shadow Foreign Secretary blasted after claiming anti-apartheid hero would have condemned student pro-Gaza campus protests, as Mandela’s grandson calls for students worldwide to join protests

Zwelivelile Mandela, Nelson Mandela’s grandson, has reacted with outrage to comments by David Lammy, Keir Starmer’s Shadow Foreign Secretary, suggesting that Nelson Mandela would have opposed the campus protest movement of students opposing Israel’s genocide in Gaza.

Lammy, like his boss, has consistently provided political cover for apartheid Israel’s racist mass murder of tens of thousands of Palestinian civilians, overwhelmingly women and children.

Zwelivelile responded to Lammy’s comments by describing Lammy as an “apologist for genocide” and calling on students worldwide to join the protests:

We call on students all over the world to emulate the student protest encampments on USA University Campuses.

[Friday, 10th May 2024] marks 30 years since the inauguration of President Nelson Rolihlahla Mandela on the 10th May 1994. I dedicate the memory of this day to the students protesting on USA University campuses calling for an immediate ceasefire of the genocide of Gaza and supporting the struggle of the Palestinian people for freedom.

We recall Madiba’s historic words on this day when he said: “We dedicate this day to all the heroes and heroines in this country and the rest of the world who sacrificed in many ways and surrendered their lives so that we could be free.”

Contrary to what David Lammy, the Labour MP in the UK would like us to believe, Madiba acknowledged the heroes in the Civil Rights Movement in the USA and campuses all over the world who regularly protested for our freedom.

He himself was of that generation of South African youth who called for the armed struggle in the face of increasing state brutality in dealing with peaceful protest against Apartheid.

The youth on USA campuses are emulating and following in the brave footsteps of the youth of 1968 who came out openly protesting against the war in Vietnam.

On countless occasions acknowledged the role of the student protests of 1976 Soweto Uprising for playing a seminal role in our march to freedom.

From his prison cell he echoed the call to the students of the 1980s to make South Africa ungovernable.

David Lammy mustn’t be an apologist for Apartheid Israel and for the ongoing genocide in Gaza. He must echo President Nelson Rolihlahla Mandela’s commitment to the Palestinian struggle which he affirmed during his visit to Gaza in 1995 when he said: ” Our freedom is incomplete without the freedom of the Palestinian people.”

We call on David Lammy to stop being an apologist for genocide and instead encourage all students on UK and European university campuses to emulate their fellow students in the USA in their call for a ceasefire in Gaza and support the struggle of the Palestinian people for freedom.

Youth are the conscience of our world and their voices are the moral compass that guide us to a better future. Rather than brutalize them and criminalize their protest actions, we must encourage them to continue to stand for justice, human rights and dignity for all humanity. You are our heroes, we salute you.

Zwelivelile is right. Lammy could not be more wrong. Free Palestine.

The following is a guest post by Eric Schliesser (University of Amsterdam) on how university administrators have been reacting to protests on their campuses.

Once upon a time, university presidents knew that by mid-May campus would be emptied of most students, including the student activists and the student reporters of the campus daily zine, all of whom had impressive internships lined up with NGOs in DC or foreign countries. Some seniors would even be willing to forego the cause in order to party one last time with classmates in graduation week. That is to say, they knew they could manage the clock as they pleased while they organized some sanitary facilities for the ‘encampment’ and exhibit curiosity about the underlying issue by proudly attending the teach in. After all, the world’s experts on the topic are often on payroll. (A good thing that interdisciplinary program was not cut.)

One of the oddities of our age is that the professional managers that have taken over the running of universities show themselves so unimaginative and so insecure with their authority. They echo each other’s slogans, and they role-play leadership from behind a large desk. Even as risk and reputation managers they are a flop. This is not just an American thing (although the armed snipers on rooftops are). The first time I noticed this state of affairs was a few years ago when peaceful student campers/campaigners got kicked off my Amsterdam campus with non-trivial police brutality because a dean didn’t want them present near graduation. I forget the activists’ cause, but not the triviality that moved the campus hierarchy into action.

When universities resort to force long before that’s necessary—and the present generation of student activists have been a most harmless bunch, so far (has anyone been physically hurt by any of them?)—they educate their students to distrust argument, they teach their students cynicism about persuasion, and they teach them contempt for the gift of civilization, which is all about the art of managing fierce disagreements with words. They teach our students that education is not about patience and the slow mastery of skill, but that it is all about who has the ear of the police commissioner. They deny their students the possibility to discover and thereby learn from their mistakes, but teach them that obedience pays.

I am no friend of the aesthetic frisson that some of my leftwing colleagues feel when they see a mass of mostly young human bodies gathered in protest facing off with men (well mostly men) in uniform; the breathless reports from the ‘streets,’ the talk of demos and democracy, the instinctive trust of the crowd by the lords of a dinner-party. I detest the unwillingness to make distinctions because solidarity demands it. I find it comic when full professors insist that social hierarchy must be abolished. But, at least, their passion pays respect to something other than force.

It’s been shocking how impoverished, craven, and imprudent the leadership of the Anglophone’s wealthiest and flagship universities have been this past year. Yes, they face organized hostility from many sides. But that is, alas, the human condition.

A bit over a year ago I tried to organize my thoughts on these matters and wrote a piece for my campus newspaper, although it was originally written in Dutch. I circulated a draft among some of my department colleagues. They all urged me to remove an inchoate idea that I expressed with the clumsy and archaic phrase, ‘spiritual authority.’ And I did. I should have asked for better suggestions.

I regret dropping the phrase ‘spiritual authority.’

Yes, repressive tolerance for its own sake is potentially a higher form of cynicism. But true authority is born from a self-confidence that doesn’t originate in a job-title or praise; it is rather nourished because one is secure in one’s identity in serving the university’s mission to elevate us, to discover new truths, and to expand our intellectual horizons, to organize curiosity. All discovery is a journey into the unknown, a voyage without a clear destination, and without knowing what will ‘work.’ And this is grounded in a kind of faith that I have called ‘spiritual.’

A certain self-described ‘realist’ thinks that an institution’s true nature is revealed when water-cannons, batons, and shields (or worse) are deployed against their own students. It’s true now. Some of our very best will walk away from us in disgust.

But universities haven’t lasted for centuries without turmoil, and bouts of renewal. Perhaps, on some campus (originating in the Latin for ‘field’), or encampment of tents, some of the more thoughtful young will have seen through the façade of the administrative building, and sketched a vision for a virtual (not in the new sense of ‘online’ but in the supposedly obsolete sense of ‘full of excellence’) university.

The propaganda of pro-Israel groups and ‘mainstream’ media was again exposed last night after a pro-Israel mob of around one hundred mounted an assault on University of California Los Angeles (UCLA) students protesting peacefully against Israel’s genocide in Gaza. Thugs attacked students with sticks, poles and chemical spray, pulled down barriers and tents and committed, according to a university administrator, ‘horrific acts of violence’ against young people demonstrating against war crimes. The assault began just before 6am today, UK time.

Police were reportedly slow to disperse the attackers.

Despite the one-sided violence, UK and US press have persisted in headlines that ‘both-sides’ the violence, presenting it as ‘clashes’ or ‘violence between groups’ in a sick echo of the language used by media to hide the reality of Israeli military and settler violence against Palestinians:

Breaking: Columbia University ‘will not divest from Israel’

University president continues capitulation to Israeli pressure

The student protest camp for Gaza at Columbia has been assaulted several times by police

Columbia University in New York will not divest its investments in Israeli firms and firms that supply weaponry to Israel, according to the university’s president Minouche Shafik, despite demands from thousands of its students who are protesting in solidarity with the Palestinian people and against Israel’s genocide. Shafik, echoing the narrative of Israel lobbyists, has even claimed that the protests have made the university unsafe for Jewish students, even though Jewish students and faculty members are playing a leading role in the protests, as if the feelings of some students, who don’t like to be confronted with the reality that a country they support is engaged in genocide, are more important than stopping mass murder of women and children.

The announcement continues Shafik’s shame after she failed to challenge a narrative spouted by pro-Israel lawmakers during her questioning by politicians – and claimed a pro-Palestine professor at the university had been sacked and would never teach at Columbia again, a claim denied by Professor Mohamed Abdou.

Columbia is one of a string of universities across the US that have shamed themselves by calling in armed police to arrest and disperse protests against the genocide in Gaza. Some, parroting the pro-Israel lobby, have even accused the students of ‘siding with terrorists’.

Meanwhile, Israel continues to slaughter hundreds of Palestinians daily, mostly women and children – and the US is trying to block a planned warrant by the International Criminal Court for the arrest of Israel’s war criminal prime minister and other ministers for Israel’s war crimes.
